1. Acceptance of Terms

By accessing and using Photonicity's lead generation services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

Photonicity provides lead generation services through various digital marketing channels including social media advertising, search engine marketing, and multi-channel campaigns. Our services are designed to identify and deliver qualified leads that match your specified criteria.

3. Pricing and Payment Terms

Lead pricing is as follows:

  • Social Media Leads: $40 per qualified lead
  • Search Engine Leads: $50 per qualified lead
  • Premium Multi-Channel Leads: $60 per qualified lead

Payment is due upon delivery of qualified leads. We accept major credit cards and bank transfers. All prices are in USD and exclude applicable taxes.

4. Lead Quality Standards

We guarantee that all delivered leads meet the following criteria:

  • Verified contact information
  • Demonstrated interest in your products or services
  • Match your specified demographic and geographic criteria
  • Have not been sold to competitors within the past 30 days

5. Refund Policy

If a delivered lead does not meet our quality standards, you may request a refund or replacement within 7 days of delivery. Refund requests must include documentation supporting the quality concern.

6. Client Responsibilities

Clients are responsible for:

  • Providing accurate targeting criteria and requirements
  • Responding to leads in a timely manner
  • Maintaining compliance with all applicable laws and regulations
  • Not reselling or redistributing leads to third parties

7. Confidentiality

Both parties agree to maintain the confidentiality of all proprietary information shared during the course of our business relationship. This includes lead data, targeting strategies, and business processes.

8. Limitation of Liability

Photonicity's liability is limited to the cost of the leads provided. We are not responsible for any indirect, incidental, or consequential damages arising from the use of our services.

9. Termination

Either party may terminate this agreement with 30 days written notice. Upon termination, all outstanding payments become due immediately.

10. Intellectual Property

All proprietary technology, processes, and methodologies used by Photonicity remain our exclusive intellectual property. Clients receive no rights to our technology or processes.

11. Compliance

All lead generation activities comply with applicable laws including CAN-SPAM Act, TCPA, GDPR, and other relevant privacy and marketing regulations.

12. Dispute Resolution

Any disputes arising from this agreement will be resolved through binding arbitration in El Paso, Texas, under the rules of the American Arbitration Association.

13. Modifications

Photonicity reserves the right to modify these terms at any time. Clients will be notified of material changes via email at least 30 days in advance.

14. Governing Law

This agreement is governed by the laws of the State of Texas, United States of America.
